Privacy notice
This is an English translation of our German privacy notice (Datenschutzerklärung). If the two differ, the German version applies.
1. Privacy at a glance
This website works without analytics tools, without advertising and without content from third parties. We process personal data in two cases only: when the server logs technically necessary data as a page is requested, and when you send us details yourself – through a form, by email, phone or WhatsApp. The sections below explain what we use these details for, how long we keep them and which rights you have.
2. Controller
The controller responsible for processing personal data on this website is:
MioVita UG (haftungsbeschränkt)
Edelweißweg 9
26160 Bad Zwischenahn
Phone: +49 151 42112113
Email: office@miovita.org
3. Hosting and server log files
This website runs on a server of Hetzner Online GmbH, Industriestr. 25, 91710 Gunzenhausen, in Germany. When you visit the website, the server processes technically necessary data: IP address, date and time of access, the page requested, the amount of data transferred and information about browser and operating system. This data is stored in log files and deleted after 14 days at the latest.
The legal basis is Art. 6(1)(f) GDPR. Our legitimate interest is the secure and reliable operation of the website.
4. Encrypted transmission
This website can only be reached over an encrypted connection (SSL/TLS). You can tell by the "https://" in your browser's address bar. Details you enter in a form cannot be read by third parties on their way to us.
5. Inquiries by form, email and phone
If you contact us by form, email or phone, we process the details you provide (for example name, company, email address, phone number, pick-up and destination, preferred date and your message) in order to handle your inquiry.
The legal basis is Art. 6(1)(b) GDPR where your inquiry aims at concluding a contract, and otherwise Art. 6(1)(f) GDPR (interest in answering inquiries). We delete your inquiry once it has been dealt with and no statutory retention duties apply.
6. Contact via WhatsApp
This website offers a link for writing to us on WhatsApp. WhatsApp opens only when you click that link; no data is sent to WhatsApp before. The provider in Europe is WhatsApp Ireland Limited, Merrion Road, Dublin 4, D04 X2K5, Ireland.
The content of messages is end-to-end encrypted. WhatsApp does, however, process data about the communication itself (for example phone number, time and device information) and may transfer it to affiliated companies in the USA. WhatsApp's own privacy policy applies to that processing.
We use your message and phone number only to deal with your request. The legal basis is Art. 6(1)(b) GDPR where a contract or steps towards one are concerned, and otherwise Art. 6(1)(f) GDPR. If you prefer not to use WhatsApp, you can reach us just as well by form, email or phone.
7. Pre-registration and application as a courier
If you pre-register or apply as a courier through the form, we process the details requested there: first and last name, phone number, email address, place of residence, vehicle, information about your work permit, your experience with delivery apps and your availability, and your message.
We use these details only to handle your pre-registration or application and to contact you. The legal basis is your consent (Art. 6(1)(a) GDPR) and Section 26 of the German Federal Data Protection Act in conjunction with Art. 6(1)(b) GDPR (steps prior to entering into an employment relationship).
You can withdraw your consent at any time with effect for the future, for example by email to office@miovita.org. We will then delete your details.
If your application is rejected, we delete your details six months after the rejection. If you are hired, we transfer the necessary details to your personnel file.
8. Where your details are stored and who receives them
What you send through a form is stored in a database on our server. Only the people in our company who handle inquiries and applications have access to it.
We are notified of every new submission by email. The notification contains your details and is stored in our mailbox, which is operated by our email service provider. We delete it after the same periods as the entry in the database.
Backups: to protect against data loss, the database is backed up every day. A backup is deleted after 30 days. For that long, an entry that has already been deleted may still be contained in a backup; it would be restored from there only when recovering from a loss of data.
We do not pass your details on to other third parties unless we are legally obliged to do so.
9. Protection against misuse of the forms
To detect automated submissions we check forms technically (among other things with a field that is invisible to people) and limit the number of submissions per IP address. For this purpose the IP address is processed only briefly in memory and is not stored permanently. Submissions classified as suspicious are deleted after 30 days. The legal basis is Art. 6(1)(f) GDPR.
10. Cookies and analytics
This website uses no cookies for analytics or advertising, uses no analytics tools and loads no content from third parties. Only the internal administration area sets a technically necessary session cookie. A consent banner is therefore not required.
11. Voluntary provision and no automated decision-making
You are not obliged to send us any data. Without the details marked as required, however, we cannot handle your inquiry or application. There is no automated decision-making and no profiling; people decide on inquiries and applications.
12. Your rights
You have the following rights regarding the personal data concerning you:
- access to the data stored (Art. 15 GDPR)
- rectification of inaccurate data (Art. 16 GDPR)
- erasure (Art. 17 GDPR)
- restriction of processing (Art. 18 GDPR)
- data portability (Art. 20 GDPR)
- withdrawal of consent with effect for the future (Art. 7(3) GDPR)
Please use the address given above; an informal message is enough.
13. Right to object
Where we process your data on the basis of Art. 6(1)(f) GDPR (legitimate interest), you have the right to object to that processing at any time on grounds relating to your particular situation (Art. 21 GDPR). We will then no longer process the data unless we can demonstrate compelling legitimate grounds that override your interests, or the processing serves the establishment, exercise or defence of legal claims.
14. Right to lodge a complaint
You have the right to lodge a complaint with a data protection supervisory authority. The authority responsible for us is the State Commissioner for Data Protection of Lower Saxony (Der Landesbeauftragte für den Datenschutz Niedersachsen), Prinzenstraße 5, 30159 Hannover, Germany.
